1 We reserve the right to change your Account terms (including the APRs) at any time. Rates are also subject to change if this account is not maintained in good standing. Your Annual Percentage Rates (including any introductory and special promotional rates) may terminate and increase up to the Default APR for any of the following reasons: If you fail to make at least your Minimum Payment when due twice in the most recent six month period; you exceed your Credit Limit, or make a payment to us that is not honored by your bank. Factors we may use to consider whether your rates will in fact increase up to the Default APR will include the length of time in which the Account has been opened, prior Account usage and performance, and any delinquency patterns demonstrated with us.

2The Prime Rate used to determine your APR is the highest Prime Rate published in the "Money Rates" section in The Wall Street Journal two business days prior to the Closing Date for that billing period. Variable APR’s are based on the prime rate of 5.25% as of 4/1/2008.

Payments will be applied to any introductory or promotional rate balances before they are applied to any balances with higher rates. Therefore all lower APR balances will be paid off prior to any balances at higher rates.

Important Information About Procedures for Opening a New Account

To help the government fight the funding of terrorism and money laundering activities, the USA PATRIOT Act requires all financial institutions to obtain, verify, and record information that identifies each person who opens an Account. What this means for you: When you open an Account, we will ask for your name, physical address, date of birth, and other information that will allow us to identify you. We may also request to see your driver's license or other identifying documents.

Additional Agreements and Authorizations

By submitting this application, you are applying for a credit card account with MetaBank ("MetaBank" or "we"). You acknowledge that you have reviewed all the information entered on the application and affirm that it is true and complete. You are at least 18 years of age and a U.S. citizen or permanent resident alien with a valid permanent home address within the 50 United States or the District of Columbia to be eligible to apply. You authorize MetaBank to obtain one or more consumer credit reports to determine your eligibility for credit, renewal of credit, future extensions of credit. If you ask, we can provide the name and address of each credit bureau from which we obtain a credit report about you. You must have a minimum annual household income of $25,000 to be considered for a GreenPaySM MasterCard® account. We will verify your credit status, income and other information. Based on this, we determine the actual credit line on your account if an account is in fact opened. MetaBank reserves the right not to open any account. If an account is opened, you agree that the use of the account, account number, or any card issued in connection with this account constitutes your acceptance of, and is subject to, the terms and conditions (including binding arbitration) of the MetaBank Credit Card Agreement and Disclosure Statement ("Cardholder Agreement") that will be sent with your card(s). You also acknowledge that your participation in the GreenPay RewardsSM Program will be governed by the Program Terms and Conditions, a copy of which will be sent with your card(s). MetaBank, in its sole discretion, may allocate your payments to balances with lower APRs (including introductory and promotional rate offers) before balances with higher APRs. You agree to be responsible for all charges incurred on the account according to the Cardholder Agreement. For joint credit card accounts, you are responsible, both together and individually, for the entire outstanding balance on the account. You also agree that the Cardholder Agreement and your account are governed by Federal law and by the laws of the State of South Dakota to the extent that Federal law is not controlling, and as outlined in the Cardholder Agreement that we reserve the right to change the terms of your account (including, but not limited to, rates and fees) at any time for any reason. The terms described in this application supersede those in all previous applications.

Balance Transfer Terms and Conditions

You agree to allow up to 30 days in order to process your Balance Transfer request to this GreenPaySM MasterCard® credit card account. Interest may begin to accrue on the transferred balance as of the date the balance is transferred to your GreenPaySM MasterCard® credit card account. Until you confirm that a Balance Transfer has been completed, you should continue to make all required payments on the other account(s) until you have received confirmation from those institutions. MetaBank is not responsible for any fees or finance charges incurred on any other account prior to your balance transfer requests being completed, nor for any remaining balance or additional charges in the event the payment amount you authorized does not satisfy any total outstanding balance. We will not close your other accounts. In the event you wish to close another account after transferring the entire outstanding balance to your MetaBank credit card account, you must still contact the other creditor(s) directly. The minimum individual transfer request that will be honored is $250 and the total amount(s) paid and transferred are subject to your total credit line assigned and available for Purchases. If you submit multiple Balance Transfer requests that exceed your credit limit, we may either send full or partial payments to your other creditors in the order in which you provided the requests to us. Your credit card account must be in good standing and MetaBank reserves the right to refuse any Balance Transfer request. Balance Transfer requests will not be processed if made payable to you, an individual, a deposit account, or cash. If you make purchases at any time during a statement cycle in which you have an outstanding balance transfer, you must pay the entire New Balance (including the balance transfer balance) shown on your account statement by the Payment Due Date in order to avoid accruing Finance Charges on those purchases. MetaBank, in its sole discretion, may allocate your payments to balances with lower APRs (including promotional offers and new transactions) before balances with higher APRs.

Married applicants may apply for separate accounts in their own names.

California Residents: Married applicants may apply for separate credit.
Notice to Married Wisconsin Residents: No provision of any marital property agreement, unilateral statement, or court order applying to marital property will adversely affect a creditor's interests unless prior to the time credit is granted, the creditor is furnished with a copy of the agreement, statement or court order, or has actual knowledge of the provision. In addition, you must send us the name and address of your spouse within 15 days to Credit Card Center: 3475 Piedmont Road Suite 220, Atlanta, GA 30305.
New York Residents: May contact the New York State Banking Department at 1-800-522-3330 to obtain a comparative listing of credit card rates, fees and grace periods.
Ohio Residents: The Ohio law against discrimination requires that all creditors make credit equally available to all credit worthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.

Privacy Disclosure

This Privacy Disclosure explains the privacy policies of MetaBank and Fintura Corporation (“Company”) with respect to this credit card program.

We are committed to protecting our customers’ privacy and security. This disclosure explains what information we collect about you, with whom we share it, and how you can direct us not to share certain information with certain parties. Please read this Policy carefully.

DEFINITIONS

We, our, and us, means MetaBank and Company, the marketer for your credit card issued by MetaBank.

You and your, means customers with a credit card issued by MetaBank, as well as any consumers who enroll for a credit card issued by MetaBank.

Nonpublic personal information, means information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records. Hereafter we will use the term “information” to mean nonpublic personal information as defined by this section.

Affiliate, means a company MetaBank or Company owns or controls, a company that owns or controls MetaBank or Company, or a company that is owned or controlled by the same company that owns or controls MetaBank or Company. Ownership does not mean complete ownership, but means enough to have control.

Nonaffiliated third party, means a person not employed by MetaBank or Company or a company that is not an affiliate of MetaBank or Company.

Opt out, means a choice you can make to prevent certain sharing or use of information. We will explain how you can exercise this choice.

INFORMATION WE COLLECT AND DISCLOSE

We collect and may disclose the following information about you:

  • Information you provide on applications or other forms, such as name, address, e-mail address, social security number, telephone number, and date of birth;
  • Information about your transactions with us, our affiliates, or other parties, such as card balance, payment history, parties to transactions, and card usage; and
  • Information we receive from a consumer reporting agency, such as verification of your identity and creditworthiness.

We may also collect and disclose information about how users use our Web site, for example, by tracking unique views received by pages of the Web site or the domains from which users originate. This information is not personally identifiable. We may also use “cookies” to track returning users to our Web site. A cookie is a piece of software that a Web server can store on the users’ PCs and use to identify the users should they visit the Web site again. Information collected may be associated with nonpublic personal information users provide us through our Web site.

INFORMATION WE SHARE WITH SERVICE PROVIDERS OR JOINT MARKETERS

We may disclose all of the information we collect, as described above, to companies (including affiliates) that perform services on our behalf, including those who assist us in preparing and mailing statements (if applicable) and responding to customer inquiries. We may provide that information, except for information from consumer reporting agencies, to others who perform marketing services for us and to financial institutions that are not our affiliates with whom we jointly offer financial products or services. You do not have the right to opt out of the disclosure of this information.

INFORMATION WE SHARE WITH AFFILIATES

Our respective affiliates include nonfinancial companies, and may include financial service providers, such as insurance companies. In addition to the information we share with affiliates that provide services to us, we may share information described above among our respective affiliates in order to provide you with information about additional products and services. You have the choice to opt out from our sharing of information with affiliates although, even if you opt out, we may still disclose your information as permitted by law.

INFORMATION WE SHARE WITH NONAFFILIATED THIRD PARTIES

We may disclose information to third parties who do not belong to our corporate family. These nonaffiliated third parties may include financial services providers, such as mortgage and insurance companies; nonfinancial companies, such as direct marketers, retailers and publishers; and others, such as nonprofit organizations.

You have the choice to opt out from our sharing of information with these types of third parties although we may still disclose your information as permitted by law. In addition, we generally will not disclose information to nonaffiliated third parties as long as your billing address is in California or Vermont except as permitted by law.

YOUR RIGHT TO OPT-OUT OF DISCLOSURES TO AFFILIATES AND NON-AFFILIATED THIRD PARTIES

If you prefer that we not share nonpublic personal information about you with third parties, you may opt-out of those disclosures at any time by directing us not to make those disclosures (other than disclosures permitted or required by law). INFORMATION SECURITY

We restrict access to nonpublic personal information about you to our employees who have a need to know such information (e.g., to process your transactions). We train our employees on the importance of customer privacy and confidentiality. We also maintain physical, electronic, and procedural safeguards that comply with federal standards to guard the nonpublic personal information of our customers.

INFORMATION ABOUT FORMER CUSTOMERS

The privacy policies and practices described in this Privacy Disclosure also apply to our former customers.

We are not responsible for content or privacy policies or practices of any advertisers or linked sites of any third parties. We encourage you to review their privacy policy before providing them with any personally identifiable information. Third party sites may collect and use information about you in a way that is different from this policy.


CHANGES TO THIS PRIVACY DISCLOSURE

We may change our Privacy Disclosure from time to time. We will provide current customers with a revised disclosure that describes the new practices as required by law.

SPECIAL NOTICE FOR CALIFORNIA RESIDENTS

In order to comply with California law, if our records with respect to your card indicate a California address we will not disclose information that we have about you outside of our family of companies, unless otherwise permitted by law.

SPECIAL NOTICE FOR VERMONT RESIDENTS

In order to comply with Vermont law, if our records with respect to your card indicate a Vermont address we will not disclose nonpublic personal financial information about you to nonaffiliated third parties, other than permitted by law, unless you authorize us to make that disclosure. Your authorization must be in writing or, if you agree, in electronic form. If we disclose information about you to nonaffiliated third parties with whom we have joint marketing agreements, we will only share information about your name, contact information, and our own transactions and experiences with you.
